At the time cerivastatin was introduced in the market, it was known that use of statins can lead to a severe and potentially life-threatening condition known as rhabdomyolysis, and that the risk of this disorder is increased when statins are taken concomitantly with fibrates, another group of substances used to treat blood lipid disorders.

His lawyers had produced e-mails and internal documents to argue that Bayer didn't adequately warn doctors about the possible side effects of the drug before it was pulled off the market.
Bayer had acknowledged the link between the drug and a side effect called rhabdomyolysis -- a rare but life-threatening condition in which muscle cells are destroyed -- but said it acted responsibly by withdrawing the drug in August 2001.
