Bazel contends that he is eligible because he was not engaged in a continuing criminal enterprise, even though the government did demonstrate that he was an "organizer, leader, manager, or supervisor" of a criminal operation.
Bazel insists, however, that the use of the conjunctive "and" in the statute and Guideline requires the government to prove both that Bazel was not an "organizer, leader, manager, or supervisor" and that he was not engaged in a CCE.
Bazel concedes that he must meet the requirements of each of the subsections in § 3553(f)(1)-(5), even though each of these subsections is separated by a semicolon.

K.P.C. de Bazel: designer to the elite
De Bazel’s furniture was initially Neo-Gothic in style but, influenced by Theosophy and the art of antiquity, he soon began to adopt mathematical systems of design which led to harmonious, classical proportions in the interior.
De Bazel occupied a rather isolated position in his own day, when — thanks to Berlage — the concept of art by and for the entire community was at the height of its popularity.
But although De Bazel produced designs that made no reference to folk art and were available only to a small social elite, they are still unmistakably products of their time.
