Water from another watershed or source which enters the Bear River by actions within a state may be claimed exclusively by that state and use thereof by that state shall not be subject to the depletion limitations of articles IV, V and VI.

The original Bear River Compact of 1958 and the Amended Bear River Compact of 1980, in conjunction with the Bylaws of the Bear River Compact Commission, various court decrees, and the laws of the States of Wyoming, Idaho, and Utah, establish the framework under which the waters of the Bear River are divided.
The Bear River Commission recognized the need of an unofficial record of events and the personnel that were involved in the formulating and the administration of the Bear River Compact and the Amended Bear River Compact.
Bear River flow reaching Stewart Dam, the point of diversion to Bear Lake, has not in the 68-year period of record exceeded 5,000 cfs (maximum of record, 5,000 cfs in 1984).

The Bear River massacre, also called the Battle of Bear River and the Massacre at Boa Ogoi, took place on January 29, 1863 between the U.S. and the Shoshone Indians at the confluence of the Bear River and Beaver Creek in present day Franklin County, Idaho.
The U.S. was led by Col. Patrick Edward Connor and the Shoshone by Chief Bear Hunter.
Connor's troops traveled from Fort Douglas, Utah to Chief Bear Hunter's camp 120 miles north in early January.

This recommendation is based on the assumption that aquatic organisms in the Bear River system are adapted to an annual hydrograph with a spring peak driven primarily by run-off from snowmelt.
Unfortunately, the Bear River is so regulated that it is difficult to determine when high flows are the result of natural conditions or the result of releases from storage.

On 29 January 1863 Colonel Patrick Edward Connor and about 200 California Volunteers attacked a Northwestern Shoshoni winter village located at the confluence of Beaver Creek and Bear River, twelve miles west and north of the village of Franklin in Cache Valley and just a short distance north of the present Utah-Idaho boundary line.
This band of 450 Shoshoni under war chief Bear Hunter had watched uneasily as Mormon farmers had moved into the Indian home of Cache Valley in the spring of 1860 and now, three years later, had appropriated all the land and water of the verdant mountain valley.
Of the six major Indian massacres in the Far West, from Bear River in 1863 to Wounded Knee in 1890, the Bear River affair resulted in the most victims, an event which today deserves greater attention than the mere sign presently at the site.
