Beaver Creek, Oregon - Wikipedia, the free encyclopedia

Oregon Judicial Department Appellate Court Opinions
On appeal, Beaver Creek argues that, as a matter of law, it is entitled to a revised certificate under ORS 759.025(2) to serve its new members.
Finally, Beaver Creek argues that the PUC's determination that the certification requirements of ORS 759.020 apply to cooperatives is precluded by federal preemption under Section 253 of the Telecommunications Act of 1996.
Beaver Creek's argument that the PUC's ruling somehow erects an impermissible barrier to entry for cooperatives is similarly unpersuasive.

Oregon Judicial Department Appellate Court Opinions
Beaver Creek argues that the PUC, in adopting each of those rules, exceeded the scope of its statutory authority and that the rules are consequently invalid.
Rather, Beaver Creek's fundamental argument is that "cooperatives are not within the statutory provisions of ORS 759.020" and that, consequently, OAR 860-032-0010(4) and (5) depart from a legal standard expressed or implied in the statute being implemented.
Alternatively, Beaver Creek argues that the territory allocation statutes, ORS 759.500 to ORS 759.570, to which the PUC referred in its order adopting the proposed rules, are preempted by the Telecommunications Act, and that, consequently, OAR 860-032-0010(4) and (5) are invalid.

Wetlands in the floodplain of Beaver Creek, a Thurston County tributary to the Black River, support one of only four known Oregon spotted frog (Rana pretiosa) populations in Washington.
Oregon spotted frogs selected areas with low vegetation dominated by reed canarygrass or, less frequently, slough sedge.
Vegetation structure was either cropped low or pressed flat by vehicle tires or the elements (wind and snow), conditions which allowed full exposure of the water’s surface to the sun.
