Friday January 04, 2008, 1:22 PM A Superior Court judge this morning dropped a lawsuit against Bernards Township filed by a couple upset that officials approved their plans to build a $230,000 swimming pool, then ordered them to fill it in.
The township had issued a construction permit in error to the couple, Susan and Jeffrey Pesot, then ordered them to fill it in after realizing it was larger than local zoning allowed.
Lawyers for the township, the board of adjustment and the Pesots appeared before Superior Court Judge Yolanda Ciccone in Somerville on the township's motion for summary judgment to avoid a trial, at least against the municipality.
