The Hindu : Business : Birlas place Will before court
The Birlas today placed before the Calcutta High Court what they described as the original of the purported mutual Will of the late M. Birla and the late Priyamvada Birla made in 1982 but sought permission to submit notarised copies of it with their probate application, expressing concern over its safety.
While placing the purported mutual will before Justice Kalyanjyoti Sengupta, Birlas' counsels, Satyabrata Mukherjee and P. Roy, submitted that it was an original document and as it was not registered they be allowed to submit notarised copies of it along with their probate application.
This prompted Birlas' counsel to offer to change his prayer even as R. Lodha's counsel, Anindya Mitra, not only opposed Birlas' prayer but also raised doubt over the originality of the will placed in the court by the Birlas.

Also, lawyers for the Birlas could argue that the ownership issue of their companies was not clear because there were cross-holdings and the companies were considered separate entities so far as their management was concerned.

Dismissing Birlas' claim of any caveatable interest in the Priyamvada Birla will case, Rajendra Lodha today submitted before Calcutta High Court that even if there exists a mutual will of 1982 it does not prevent granting of probate of a later will, which he claimed was her final testament.
Submitting that the arguments posed by the Birlas to support their claim to the property did not establish any caveatable interest in the probate application by Lodha for the 1999 will of Priyamvada, Lodha's solicitor Anindya Mitra claimed that the judgements cited by the Birlas itself were contradictory to their position.
Birlas had earlied argued that as per a mutual will of 1982 of Priyamvada and her husband, M P Birla, the entire estate was to go to charities after their death.
