Blackground's attorney Frank Penski stated that the lawsuit was meant to recover the value of lost contracts, which were not included in the Haughton Family's compensation, and that he found the decision disapointing.
Blackground mainly prefers signing multi-talented entrepreneurs who can do CEO and managerial work, as well as arrange, produce and write all their own music.

Frank Penski, Blackground's lawyer said yesterday (January 6), that he had not seen the decision and was unsure whether the label planned battle the decision.

A judge in New York has ruled that Blackground Records can indeed sue the video producer who set up transportation in the fateful plane crash in the Bahamas that resulted in the death of the singer and eight other passengers Aug. 25, 2001.
Blackground had filed a negligence suit against Instinct Productions in November 2003, faulting the producer of the "Rock the Boat" video, which Aaliyah had been filming in the Bahamas, for the plane crash, since Instinct had arranged for all transportation.
In the suit, Blackground charges Instinct with causing "harm, loss and damage" by not ensuring "the careful and safe transportation of Aaliyah." Blackground is seeking millions of dollars in damages to recover the earnings it would have received if Aaliyah were still alive.
