 Wired News: Tariff on Blank CDs? Blame Canada
Canadians may soon be smuggling blank CDs across the border in an effort to avoid the high taxes that have been proposed for any recordable media that can be used to store music.
The tax, called the Private Copying Tariff and backed by the Copyright Board of Canada, is intended to compensate musicians for income lost when consumers copy music onto digital storage media.
The proposed tax would be collected from the products' manufacturers, but industry groups said they believe the costs would be passed to consumers and would result in higher prices for all digital storage media and devices.

The taxpayer gets benefits from the programs and goal the tax is meant to support, and moreover, it is a legitimate policy initiative taken by the government and they have the power and right to tax you and other Canadians to pay for it.
Even though the blank CD I use for data storage will not be used for music recording I will still have to pay the levy, part of which will be forwarded to an artist like Celine Dion, who already has more money than I could possibly make in a hundred lifetimes.
This tax makes about as much sense as it would to tax a car owner for the air they put in their tires in order to support the airline industry because they use air as a medium to fly their airplanes.

All this is, is taxing tax itself and has nothing to do with their profit losses but rather taking every dime they possible can from willingful people.
It also violates the principle that taxes are to serve the nation and the people.
Anyways, in the US, if such a tax were imposed on media and players, it would warrant protest and revolt (in the form of civil disobedience of course, bloodshed would be too extreme for human rights violations of this type).

A tax on blank media is essentially a presumption of guilt.
Once all of these new media and recorder taxes are in place, the continued greed of industry and the success of the "lost revenue" justification will inspire them to try to ban libraries.
In the mean time I'm only buying 60 meter DDS tape, which isn't subject to the tax because it doesn't fit the definition in section 1001 (4)(A) since it isn't marketed for use by consumers to make digital audio recordings.

December 26, 1999 — In a move that is sure to enrage users of blank digital media, Canada's Copyright Board has finalized plans to add a levy of 5.2 Canadian cents on CD-Rs and CD-RWs, 23.3 cents on audio cassettes over 40 minutes in length, and 60.8 cents on MiniDiscs and recordable audio CDs.
Interestingly, DAT tapes are excluded from the tax, as they are not seen as a threat to the music business.
The CATA attempted to persuade the Copyright Board to exempt the computer industry from the tax, which came as a result of public hearings earlier this year.

After all, they get a bunch of money for not doing anything, on the off chance that maybe, just maybe, someone somewhere is using the blank media for copyright infringement.
I don't mind paying the media tax, if it provided me with access to all content, so I have choices about obtaining just and only the content that I want.
I pay this tax to the recording companies anyway to buy a whole CD that has only two songs that I want anyway, which I then record onto other meda and put the CD away.

Blame Canada" brings to light a proposed bill that would issue a tax on blank CD-R/Ws ($.59 per disk), memory cards ($.08 per megabyte) and blank DVDs ($2.27 per disk).
Also affected by the possible tax are manufacturers of MP3 players, who would be paying $21 for each gigabyte of memory available on the device.
An anti-proposal site shows a comparision of what the media costs now to what it will cost if the proposal passes -- which is doubtful according to legal experts.

I don't begin to understand how the tax system works in Europe, but it seems like Jens might be out of luck here.
Hopefully public opinion can sway the government of Sweden to change their wacky "blank media tax".

The Spanish Congress have voted to implement a tax on all blank media, including flash memory sticks, blank cd and dvd-rs, even mobile phones and printers.
There is no word on how much this new tax will be, only that the revenues will be collected by the government, and will then be given to the "copyright holder."
People have long discussed this concept, known as "compulsory licensing." Meaning that basically the government assumes people are going to be putting copyrighted material on this blank media.

Canada has had a long tradition of charging extra fees on recordable media, as a way of "subsidizing" the potential for losses to the entertainment industry.
The Canadian Supreme Court has refused to hear the case, meaning that iPods and other such music devices won't be taxed for such potential losses any more.
Consequently, in 1998, Parliament legalized the copying of music by an individual for his or her private use and, in exchange, copyright holders were allowed to impose a levy on blank audio recording media, such as CDs.

It is called a levy (and not a tax) because it is not collected by any level of government, it is collected by a group representing the recording industry.
If you buy any blank recording media outside Canada and use it yourself they will not be subject to the levy.
It is the sale of blank media by the importer or manufacturer that triggers the levy.

CRIA Watcher writes "The Canadian Copyright Board has just announced that it is bringing back the tax on blank CDs, called the private copying levy, in 2007.
Since this tax goes to the recording industry to apparently make up for "lost sales due to copyright infringement"....where can independant Canadian artists who are not affiliated with the labels sign up to receive their cut of this tax?
Point out the flaws in the assumptions behind the levy (such as the fact that not everybody is going to use the media they're taxing for copying music, etc.), and how it makes the levy unfair.

Swedish MP3 maker Jens has failed to pay Sweden's blank media tax for two years, and is now being sued.
Company chief Jens Nylander was quoted saying, "...it is not our problem that the record industry hasn't come up with its own solution to safeguard its interests." Yow.
Nylander also notes that out-of-country device builders, like Apple, are unfairly exempt from the tax.
