BnetD was an open source program that let gamers play popular Blizzard titles like Warcraft with other gamers on servers that don't belong to Blizzard's Battle.net service.
Blizzard argued that the programmers who wrote BnetD violated the DMCA's anti-circumvention provisions and that the programmers also violated several parts of Blizzard's EULA, including a section on reverse engineering.

In February 2002, lawyers for Blizzard threatened legal action against the bnetd developers under provisions of the Digital Millennium Copyright Act, in what could be an important test case for portions of that law.

Ross Combs and Rob Crittenden, two of the lead developers on bnetd, say all they ever wanted to do was create a place to play best-selling Blizzard games like Starcraft and Diablo in a friendly online atmosphere free of the technical bugs that plague Battle.net.
With bnetd's code anyone could set up their own server for playing Blizzard games, and since the code was open to the general public, they could even modify it themselves if they so pleased.
Bnetd thus joins the fast-growing list of other software causes célèbres -- Dmitry Sklyarov, 2600 Magazine, Napster -- that have emerged in the hotly contested war over intellectual property and the Internet.

Bnetd i used at a point in time before the retail version of wc3 came out.
BNetD was created to be used on LANs and such when connections to the internet were not available for things like LAN parties.
The BNetD service however, intentionally flies in the face of the copyrights of one of the few developers out there still dedicated to producing quality games with the "It's done when it's done" mentality instead of cowtowing to their publisher to release the game when it's "most profitable".

On February 17, the ISP hosting the Bnetd project received a cease and desist order from Vivendi, which claimed that a violation of copyright under the Digital Millennium Copyright Act (DMCA) had taken place.
Granted, the Bnetd developers meant well enough, but they should have thought out what they were doing in more detail.
If Bnetd had wanted to offer an alternative to Battle.net in the way that they did, they should have either created a new type of multiplayer service or designed their own game to go with it...that is honest competition (aside from which, the legality of reverse-engineering any software is a big grey area).

Certain software in addition to the bnetd server should also be considered part of the bnetd project.
Versions of bnetd after 0.4.22 have good Diablo I support as long as your client is upgraded to version 1.05 or greater.
Normally when the bnetd server is also behind the firewall, and a game is hosted by an internal computer, only other internal computers can join.

Blizzard claims bnetd is in violation of 17 USC Section 1201(b), though we do not agree with their interpretation.
Contrary to BNETD's contentions, Blizzard states that it would have been impossible for a third party to recreate specific authentication code embedded in their games by analyzing or "packet sniffing" network traffic between a Blizzard game and Battle.net.
They state some of the reasons for their filing a lawsuit, and go on to say it would be impossible for The BNETD Project to create what was done without, bascially cheating in their minds.

This is all concerned with saying that the BNETD emulator is indeed a DMCA circumvention violation, before even discussing reverse-engineering.
The "permission" refers to the fact that to be a circumvention violation, the decryption must be "without the authority of the copyright owner".

bnetd is just a fancy chat server, the games are hosted in a peer to peer fashion and don't make use of the bnetd central server except for establishing connections for games.
Bnetd is legal since it alters nothing that Blizzard made.
Whether bnetd violated that right is debatable, but even assuming that it did, I would bet that the lost sales due to piracy will be smaller than the lost sales due to the "you pissed me off and I ain't buying your crap anymore" syndrome.

Rob and Ross took over the development of BNETD in early 1999 when Mark Baysinger gave up on BNETD and said he didn't have time to work on it and manage it anymore.
One of the misconceptions that a number of people seem to have is that they think that some of the developers and/or others of "The BNETD Project" were involved with the WarForge group.
The BNETD Project is under a lot of pressure from Blizzard to stop everything and close down the entire site and just plain go away, and say that the project was wrong and violated the law.
