Boliden Ltd. is suing Liberty Mutual Insurance Company for damages in the amount of $3.5-million for breach of a policy of insurance and for $500,000 in punitive damages.
Boliden's filing says its insurance policy with Liberty "provides that, if a claim is made against both Boliden and the Directors and Officers, 80% of any combined defence costs shall be allocated to and deemed to be 'covered loss' and therefore be reimbursable.
Boliden's notice of action says: "Liberty has wrongfully, repeatedly and without justification refused to to compensate Boliden for the covered losses paid by Boliden from time to time or to pay any defence costs incurred by the Directors and Officers.

Swedish mining and metals group Boliden said yesterday an appeals court in Spain had upheld a lower court decision clearing it of any crime in connection with an ecological disaster at its Los Frailes mine.
Boliden's share jumped on the news, closing 4.7 percent up at 2.23 crowns, having hit a three-month high of 2.24 crowns.
In the statement, Boliden's Chief Executive Jan Johansson said the new ruling paved the way for Boliden to claim compensation from those who built the dam.

Madrid, Spain - The Swedish-Canadian mining company, Boliden Limited is courting environmental disaster and potentially putting more than one million people's drinking water at risk by withdrawing from Spain's Doñana National Park, without properly closing down its mine there, according to WWF, the conservation organziation.
The Guadalquivir Water Basin Authority has also said that it considers the rubber seal of the mine, put in place by Boliden, to be insecure and a potential cause of contamination in both Guadiamar and Doñana.
