The Bourbon biscuit has a cream chocolate fondant filling sandwiched between two thin rectangular dark chocolate biscuits.
The Bourbon was introduced in 1910 (originally under the name Creola) by the Bermondsey biscuit company Peek Frean, originator of the Garibaldi biscuit.
It is apparently named after the House of Bourbon, an aristocratic French and Spanish family.

I have been interested in the classification of biscuits ever since a throwaway (in her eyes) comment by the wife that a bourbon "is basically just a chocolate custard cream".
However this "3-dimension" approach, whilst giving a framework for the accurate description of most biscuits, is slightly long winded and lacks a natural "feel" for the inherent differences between, say, the aforementioned bourbon and custard cream.
The answer to your particular issue is that of course a bourbon isn't a chocolate custard cream or else it would look like one which it doesn't (your second morphology point), also Bourbons should have some little sugar crystals in the upper surface which counts as extras.

For months I've had to make do with Chocolate Digestives, or Fig Rolls, (both of which pale in comparison to Bourbons,) and Porl has had to cope with me complaining and sulking and stamping my feet about the lack of Bourbon Biscuits.

Thankfully the government have also realized how desperate this Bourbon crisis is, and they have offered McVities £1 million to help get the factory up and running again.
