In 1988 British Rail Engineering Limited was split between the major engineering works, which became BREL (1988) Ltd, and the (mostly smaller) works that were used for day-to-day maintenance of rolling stock, which became British Rail Maintenance Limited (BRML).
Foster Yeoman's class 59s proved extremely reliable, and it was not long before quarry company ARC and privatised power generator National Power also bought small numbers of Class 59s to haul their own trains.
British Rail was to be broken up into over 100 separate companies, with all relationships between the successor companies controlled by legal contracts and supervised by the Office of the Rail Regulator and, in the case of the passenger railway, the Office of Passenger Rail Franchising (OPRAF).

 British Rail Class 53 - Wikipedia, the free encyclopedia
British Rail assigned Class 53 to the single Brush Traction-built prototype locomotive Falcon.
Returning to British Railways in 1963, Falcon spent six months working out of Sheffield on both passenger and freight diagrams, after which its testing was completed.
In 1970, British Rail approached Brush Traction with a proposal to buy the (by now practically worthless) locomotive for its scrap value, which was accepted by the builder; the loco underwent a rebuild at BREL Swindon, emerging in corporate Rail Blue with full yellow ends and bearing the new number D1200.

Class action legislation requires the court to certify a proceeding as a class proceeding if certain statutory requirements are met.
In order to resolve the statutory conflict, the British Columbia Court of Appeal ruled that where a court finds that a class proceeding must be certified by meeting the statutory test set out in the applicable legislation the court must find that the arbitration agreement is ‘inoperative’.
In essence, the British Columbia Court of Appeal in Mackinnon resolved the statutory conflict by requiring a court to weigh the circumstances of each case to determine whether a class proceeding or arbitration is the preferable procedure.
