British Rail changed the requirements for this locomotive, by which point Brush had already committed to construction of this locomotive as a prototype.
British Rail was asked to participate and sent a representative train of vehicles to the exhibition.
British Rail for its part had written off the locomotive as part of the ECML development and thus it was seen as a surplus and nil value asset.

Gangs of men were crowded on to the work, moving the soil then the water, assisted by the heavy fall of 1 in 9¾ represented by the gradient, scoured away the loose detritus effectively, economically, and expeditiously, leaving behind the heavier stone, which was utilised for building purposes.
At the foot of the fourth incline a deep chasm had to be crossed by means of a viaduct 705 ft. in length, divided into one 45-ft. and ten 66-ft. spans, with the rails, in the centre of the viaduct, 185 ft. above the floor of the valley.

The issue of settlement in class actions is always problematic because of the risk that plaintiff class counsel will, with or without colluding with the defendant, "sell out" the class (settle for less than the case is really worth) to gain what the counsel sees as a satisfactory fee.
Although it is apparent that some judges are unsympathetic to some class actions, on the whole, the Canadian judiciary seems to have recognized that class actions have an important and valuable role to play by affording access to justice to many who could never in their wildest dreams hope to litigate individually.
