I understand that the Manitoba’s Vital Statistics Agency has instructed marriage commissioners to marry same-sex couples or resign.Such an ultimatum is not only morally repugnant to many Canadians, but I believe as a matter of law it is wrong.
Furthermore, any marriage commissioner who has agreed to end his or her appointment as a result of the directive from the department should be advised that he or she is entitled to be reinstated if the reason for the termination was for religious beliefs or practices.
Should the Government of Manitoba decline to change the direction of the Vital Statistics Agency in order to reasonably accommodate any affected marriage commissioner by virtue of this correspondence I would ask the Commission to investigate this matter and make the appropriate order in order to remedy this breach of the law.
