Bruce Cutler was ready for this as he skilfully and aggressively tore into the credibility of each witness destroying each and every one of them who took the stand to testify against Gotti.
Cutler made a mockery of Giacalones prosecution as he literally badgered each witness into confessing their previous crimes, crimes of which stunned the jury, and turned them against the prosecution that Giacalone had thrown together.
At one point after Cutler had finished destroying the credibility of the witnesses, he attempted to discredit her by suggesting how desperate she was to go to such lengths to use criminals instead of more credible witnesses.

Cutler, the always outspoken and often outrageous legal mouthpiece for John Gotti, is the only lawyer in the United States ever to be charged with a crime for speaking out on behalf of a client.
What's more, Gang Land has no doubt that when Cutler made his remarks to any reporter with a microphone or notepad, he intended to influence potential jurors who might hear or read what Cutler had to say.
The one in which Cutler slam-dunked the indictment into the trash can, called a prosecutor a slut and ignored repeated warnings from Judge Eugene Nickerson to tone down his act and stop badgering witnesses.

Cutler had continued to work for Gotti after the notorious Mafia kingpin's celebrated fall from grace as the "Teflon Don" - so-called because of his remarkable propensity for walking away from assorted courtroom battles with the government, a free man - was incarcerated on murder and racketeering charges.
Despite Cutler's aggressive campaign to defend his favourite client, he could not contest the damning contents of taped recordings of his "Dapper" client discussing various crimes that confirmed he was the head of a massive criminal enterprise, namely the Gambino Mafia family.
Cutler confirmed that he had been contacted by ex-undercover cop, Louis Eppolito's family immediately after the former NYPD detective was arrested on Wednesday and charged with a ghastly string of murders and racketeering offences.

Bruce Cutler, one of the most famous lawyers in America, has never told his story—until now.
Cutler, the son of a detective turned lawyer, resolved his choice of profession early in life and plunged headlong into the tumultuous and at times surreal world of the New York legal system.
The years Cutler and Gotti spent together were a kind of golden age of criminal (and in particular organized crime) litigation, and both lawyer and client were at the red-hot center of it all.

Cutler responded in his opening remarks by claiming, "The only family John Gotti knows is his wife and children and grandchildren." The overly dramatic defense attorney pranced around the courtroom making disparaging comments about the prosecutor and the indictment.

Cutler served as one of his lawyers, but another attorney, Sarita Kedia, seemed to take the lead role in representing Junior.
In typical Cutler style, he evaded most of her questions, got loud when making a point, claimed that Gotti had nothing to do with the Castellano murder, and said that Gotti’s role as head of the Gambino family was “malarkey.”

In First Amendment jurisprudence there is a vast difference between the two, and it is highly unlikely, indeed substantially unlikely the Supreme Court would approve the Eastern District rule after settling in on substantial likelihood in Gentile. Oddly enough both the Eastern District rule and the Gentile Eastern District rule were drafted by the ABA.
Does this mean the judge was ordering Cutler to say nothing about the case, as it appears to be — which of course is patently unconstitutional — or is it an order to say nothing except as permitted by Rule 7?
In its decision in holding Cutler in contempt, the Eastern District concluded the language above constituted two distinct orders that Cutler should have appealed before he disobeyed them.
