Brushy Mountain State Penitentiary now renamed Brushy Mountain Correctional Complex (also called Brushy) is a large prison near the town of Petros, Tennessee, operated by the Tennessee Department of Correction.
Among the most famous inmates at Brushy Mountain was James Earl Ray, the convicted assassin of Martin Luther King, Jr.
This labor conflict was eventually resolved in favor of the coal miners with a bill passing the Tennessee state legislature to abolish the convict labor system, to be replaced by a modern penitentiary system of which Brushy Mountain was the first to be constructed.

Section 32 of the Tennessee Constitution states that "the erection of safe and comfortable prisons, the inspection of prisons, and the humane treatment of prisoners, shall be provided for." In 1796 the legislature passed three separate acts to establish courthouses, jails, and stocks in three separate counties of the state.
In 1819 Governor Joseph McMinn suggested that a loan be made from the State Bank to fund the construction of a prison, but it was not until 1829 that the legislature passed a law to build one in Nashville.
In that same year, the Tennessee State Penitentiary in Nashville was closed, and TDOC was permanently enjoined by the federal court from housing inmates there.

Ray and six other convicts escaped from Brushy Mountain State Penitentiary in Petros, Tennessee on June 10, 1977 shortly after Ray testified that he did not shoot King to the House Select Committee on Assassinations, but were recaptured on June 13 and returned to prison.
Ray died in prison on April 23, 1998 at age 70 from complications related to kidney disease, caused by hepatitis C probably contracted as a result of a blood transfusion given after a stabbing while at Brushy Mountain State Penitentiary.
