The university does not deny that it failed to adequately monitor the activities of the head wrestling coach in the recruitment of the prospect and the employment of the same prospect, later a student-athlete, in the coach's private business venture.
Many high-ranking university officials in control of university policies and procedures were alerted at one time or another to the questionable activities surrounding the wrestling program but chose not to deal directly with the situation or to develop procedures to oversee the program.

Bucknell University is a Division I institution and a member of Patriot League.
By letter dated April 23, 1998, the university professor, who had served as a volunteer assistant wrestling coach, was advised that he could be subject to sanctions as a result of his alleged involvement in possible NCAA rules violations, and he was afforded the opportunity to participate in the enforcement process.
Although the university and counsel for the head wrestling coach exchanged correspondence which was limited to the sports camp issue in April and May, the university did not pursue the information indicating possible NCAA violations until late summer.

Clearly, the university stepped over the line of appropriate action; this wasn’t a case of one professor or administrator speaking his or her opinion at a rally, this was an official arm of the university — staffed by paid university employees —; asking students to support gay marriage “in a very visible way.”
