The Liberalism/Conservatism of Burke and Hayek
Burke, in short, like his Whig forebears, believed in the existence of a higher moral law to which all valid positive law must conform,62 a universal law which manifests itself in diverse concrete forms, in the great variety of legal codes and customs that constitute particular cultural traditions.
For Burke, the natural law was the ultimate standard by which human law was to be measured, and he emphatically rejected the positivism of Hobbes and indeed any conception of law as the product of human will: "All human laws are, properly speaking, only declaratory; they have no power over the substance of original justice.
For Whigs such as Burke and Hayek, the only kind of freedom that can be secured by a political order is freedom-under-law in the sense of freedom from arbitrary coercion.

Burke rendered on a claim filed pursuant to the provisions of the Longshore and Harbor Workers' Compensation Act, as amended, 33 U.S.C. et seq.
The administrative law judge rendered this decision based upon his findings that, as claimant conceded that the articles in question were easily ascertained, those articles could have been located prior to the hearing and that claimant failed to properly introduce the disputed medical articles into the record.
As the administrative law judge did not apply the Section 20(a) presumption when addressing this issue, we vacate his finding on this issue, and remand the case for the administrative law judge to consider whether employer has rebutted the invoked presumption with substantial evidence that claimant's condition was not caused or aggravated by his employment.
