Butte County recognizes that the facilities that it uses to hold County elections are not readily accessible to and usable by person with mobility impairments.
Butte County agrees to continue to provide the option of mail ballots or absentee ballots to persons with disabilities, in accordance with South Dakota law, provided that the ballots are accepted up to and including the day of the election.
The County will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.

A County Board of Education may not reverse the decision of a Respondent school board to expel a pupil based upon a finding of an abuse of discretion unless the Butte County Board of Education also determines that the abuse of discretion was prejudicial.
The President of the Butte County Board of Education, or his/her designee, shall preside over the hearing, which shall be conducted in closed session unless the Appellant requests in writing at least five (5) days prior to the date of the hearing that the hearing be conducted in a public meeting.
The decision of the Butte County Board of Education shall be final and binding upon the pupil and the parent or guardian of the pupil and upon the Respondent school board.
