  Criminal Resource Manual 2054 Synopsis of Classified Information Procedures Act (CIPA)
CIPA is a procedural statute; it neither adds to nor detracts from the substantive rights of the defendant or the discoery obligations of the government.
The linchpin of CIPA is section 5(a), which requires a defendant who reasonably intends to disclose (or cause the disclosure of) classified information to provide timely pretrial written notice of his intention to the Court and the Government.
That is, the prosecutor must seek the court's approval, under either CIPA section 4 or section 6, of an alternative method to the witness' testimony in true name that will provide the defendant with the same ability that he would have otherwise had to impeach, or bolster, the credibility of that witness.

 Children's Internet Protection Act
Under CIPA, schools and libraries subject to CIPA do not receive the discounts offered by the "E-Rate" program (discounts that make access to the Internet affordable to schools and libraries) unless they certify that they have certain Internet safety measures in place.
CIPA does not require the tracking of Internet use by minors or adults.

In a nutshell, the plaintiffs argued that CIPA's conditions effectively mandate that libraries impose content-based restrictions on their patrons' access to constitutionally protected speech, and that such would be permissible only if there were a compelling state interest and no less restrictive alternatives were available to further that interest.
Thus, the panel declared CIPA to be facially invalid under the First Amendment and the panel permanently enjoined the government from enforcing the statute.

For the purpose of CIPA, certifications for schools eligible for E-rate discounts may be made by the relevant school, school board, local educational agency, or other authority with responsibility for administration of the school (the Administrative Authority).

Public elementary and secondary school libraries must be in compliance with the CIPA requirements to obtain FY 2004 funding from State Library Administrative Agencies, except to the extent that such school libraries are eligible for and receive a waiver of the CIPA requirements pursuant to 20 U.S.C. § 9134(f)(4)(B)(iii).
A public library must certify either that (1) the library is in compliance with CIPA's provisions, or (2) the library is undertaking steps to comply with CIPA in the next funding year.

CIPA says that a special three-judge panel will hear any legal challenge, and the losing party can appeal directly to the Supreme Court.
The Justice Department has argued that to uphold CIPA as constitutional, the judges merely have to find that it could be applied legitimately in some cases without necessarily resulting in a violation of the First Amendment.
But the free-speechers and librarians have a tougher battle this time: CIPA is not a criminal law, and nobody's forcing libraries to ask the federal government for cash.
