FindProfit.com Profitmap: Court Approves CLEC's FASTNET Purchase
CLEC's bid is worth $8.5 million and the assumption of certain liabilities and was approved by the U.S. bankruptcy court of the Eastern District of Pennsylvania.
CLEC said it expects to see "the immediate positive impact on its bottom line" from this distressed asset deal.
While CLEC likely won't retain all of the new revenue and customers provided by this deal, this asset purchase is a good example of how CLEC can use its healthy balance sheet to scoop up distressed telecom assets at attractive prices.

Important to CLEC telecommunications networking is the availability of unbundled network elements or UNEs (through a collocation arrangement).
With the local loop, CLECs will be able to connect their switches with the ILEC's switches, thus giving them access to ILEC customers.
CLEC status is very beneficial, especially for ISPs, who may easily get access to the copper loops and other switching elements necessary to provide xDSL services.

CLEC use of this strategy raises questions about the extent to which CLECs truly are subject to competition in their provision of access service.
CLECs have, in the past, set their rates without having to conform to the regulatory standards imposed on ILECs, and this Commission has twice ruled, in essence, that a CLEC’s rate is not per se unreasonable merely because it exceeds the ILEC rate.
For example, CLECs shall be permitted to set their tariffed rates so that they receive revenues equivalent to those that the ILECs receive through the presubscribed interexchange carrier charge (PICC), to the extent that it survives in the wake of our CALLS Order.

However, the primary flaw in the CLEC business plans was that they underestimated the obstructionist behavior of the Bell monopolies and did not take into account the billions of extra dollars that was needed to be spent to connect to the local phone networks, or to fulfill orders and installations.
The CLECs are the mostly small entrepreneurial firms who have attempted to compete for voice and data services (including DSL) based on the laws that were created as part of the Telecom Act of 1996.
CLECs received higher marks from their customers with respect to customer loyalty, being in touch with customer needs, timely installation of service, and professionalism of customer service staff.

I have yet to find a CLEC that doesn't have an attorney on staff to pick and choose what issues they want to go after and what issues can be dismissed.
My fear with CLEC status is that after hiring an attorney and spending perhaps $10-15,000, we would be 'addicted' to our attorney thereafter.
There is a lot to consider when becoming a CLEC to save money; not just the license and paperwork, but the staff and the expenses needed to support such an operation.

 Telecom Decision CRTC 2003-53
In ARC et al.'s submission, a wireless CLEC should be required to comply fully with the equal access obligations established by Decision 97-8.
In Order 2000-831, the Commission concluded that a wireless CLEC should provide equal access in respect to MTCs since the long distance charges are caused and payable by the subscriber roaming outside the subscriber's home exchange.
On the question of whether wireless CLECs should continue to be required to provide information for the ALI database, the parties who commented on this issue acknowledged that there were problems with the accuracy of wireless subscriber records and with the availability of customer data for many wireless subscribers.

 How to become a CLEC
Before becoming a CLEC it is recommended that you have a good telecom lawyer and a telecom technical consultant.
If however the CLEC is going after business or residential traffic, it may want to use two-way trunk groups and share the cost with the ILCE, thus lowering the number of switch ports.
That is a shame, because once the CLEC has a switch it could be used to generate as much revenue as possible.

As companies build their networks, the buzzword has been "convergence." CLECs have been at the forefront of recognizing that building two distinct voice and data networks can be a costly endeavor.

CLECs (Competitive Local Exchange Carriers) that lease facilities from the incumbent local company and do not own telecom facilities are called UNE-Ps (from Unbundled Network Element Platform).
Before 1996, the CLECs were at a disadvantage in the construction of tariff rates because they would be putting in all new facilities to provide service to the subscribers.
The Telecommunications Act of 1996 gave CLECs a big boost by mandating that the ILECs lease their facilities to the CLECs, allowing the CLECs to get into business immediately on a pay-as-you-go basis.

In the United States, a CLEC (competitive local exchange carrier) is a telephone company that competes with the already established local telephone business by providing its own network and switching.
