On Sept. 1, 2004, the California Department of Insurance (CDI) issued a notice of proposed action setting forth proposed permanent regulations regarding special investigative units (SIU) that are intended to replace the existing emergency regulations regarding SIU.
NAMIC, through it state advocacy partner, the Personal Insurance Federation of California (PIFC), worked closely with the CDI on the proposed regulations and on a related bill, AB 1227 (McCarthy), that gave the department statutory authority to impose reasonable and defined penalties on companies that fail to comply with the SIU regulations.
The proposed regulations needed to be revised to address the possibility that an insurance company could be fined or penalized for non-compliance when its action was merely an “inadvertent” non-compliance and that the regulation should be tailored to the current law that defines “willful” misconduct.
