EPAA Vol. 10 No. 7 Thompson et al.: Exito en California? A Validity Critique of Language Program Evaluations and Analysis of English Learner Test Scores
We first discuss the background, media coverage, and previous research associated with California's Proposition 227.
California students who are not proficient in English improved their scores on the Stanford 9 standardized test at about the same rate as their fluent classmates, but new state data released Monday continue to show an immense disparity between the two groups.
In the context of the California data, the misuse and misinterpretation of percentile rank scores, the inappropriate averaging of data across years and grades, and the failure to consider the unit of analysis when using aggregated data are common problems.

AEGiS-LT: Medical Experts Assail Initiative on AIDS: Officials Dismiss Claims Made by Supporters of Larouche-backed Prop. 64
CAPTION: Photo: 'I'd say right now the only place where you can get competent medical information publicly on AIDS is from us.'--Khushro Ghandhi, Top LaRouche aide in California and president of PANIC, the group sponsoring Proposition 64.
LaRouche has offered to debate Dr. Gladden V. Elliott, president of the California Medical Assn., and has suggested that Sen. Alan Cranston and his opponent in the Nov. 4 election, Rep. Ed Zschau (R-Los Altos)--both of whom signed ballot arguments opposing Proposition 64--be present.
Another claim that Proposition 64 supporters make in their ballot argument is that the AIDS virus "can survive for upwards of seven days outside the body." This claim refers to a laboratory experiment conducted by scientists at the Pasteur Institute in Paris and reported in the Sept. 28, 1985, issue of the medical journal Lancet.

 Girardeau A. Spann, Proposition 209, 47 Duke L. J. 187 (1997)
Proposition 209 was adopted by the voters of California as a ballot initiative in the November 5, 1996 general election, by a margin of 54 to 46 percent of the nearly 9 million votes cast.
California law presently contains a number of race- and gender-related programs that were valid under state and federal law prior to the adoption of Proposition 209, but whose validity after adoption of the ballot initiative is uncertain.
Proposition 209 is also replete with the naughty fascination of forbidden temptation, because of the bewitching possibility that it might be merely a ruse.

 Proposition 227--English for the Children
And because California has a legitimate state interest in improving the education of LEP students and because Proposition 227 is rationally related to that purpose, Plaintiffs cannot demonstrate a likelihood of success on the merits of their Equal Protection claim.
Because Plaintiffs acknowledge that LEP status is a necessary classification, they cannot seriously dispute that the only question raised by Proposition 227 is not one of race, but rather one of educational methodology: what is the best method of educating California's LEP students?
Proposition 227 does not attempt to address program evaluation, leaving entirely open to the State Board and local school districts the methods and models to be used in evaluating the success of programs implemented by local districts.

 California's Proposition 65
California's Proposition 65, the Safe Drinking Water and Toxic Enforcement Act of 1986,1 has attracted considerable attention as an expression of "toxics populism" and as a model for innovative reform of chemical regulation.
California regulatory agencies were not designated as authoritative to avoid the appearance of conflict of interest; both CDHS and the California Department of Food and Agriculture (CDFA) are active in the regulatory implementation of Proposition 65.
California's Court of Appeal upheld the lower court's order to expand the Proposition 65 list in July 1989, but by then about 90% of the chemicals at issue had already been nominated by the SAP and placed on the list.

(See this comment, for example.) I want to take this opportunity to dispel some common misconceptions, especially with the vote on Proposition 64, the UCL "reform" initiative, coming up in November.
The UCL Practitioner is the first and only weblog on California's Business & Professions Code section 17200 (otherwise known as the Unfair Competition Law or "UCL").
Here's how the Supreme Court once described the cy pres doctrine, on which fluid recovery in UCL actions is based: "Under this approach, the uncollected funds are disbursed to a reasonable governmental organization for use on projects that benefit noncollecting class members and promote the purposes of the underlying cause of action."
