  State v. Brown, 337 N.W.2d 138 (N.D. 1983)
Reiser, the State's expert witness, took the opposite position from that of Dr. Diamond.2 Dr. Reiser defined "hypnosis" as "an altered state of consciousness, which is characterized by an increased focus of attention, a heightened state of mental concentration, and a decrease of focus and concern about peripheral, or surrounding noises and stimuli".
The State did not introduce into evidence the videotapes of the hypnotic sessions in its case in chief for the purpose of proving the truth of the matters asserted by the witness.
The State argues that Linda knew before the hypnotic sessions that Brown was her assailant, but because of her earlier misidentification of Larry as her assailant, and subsequent admonishment to her by police to be sure of the person's identity, she was reluctant to positively identify him.

California DUI Guide: DUI Library - CA Supreme Court Rules on Warrantless Searches
Prior to and subsequent to Webster, supra, 54 Cal.3d 411, California courts have held in analogous circumstances that it is constitutionally proper for an officer to conduct a limited warrantless search of a vehicle for the purpose of locating registration and other related identifying documentation.
California's statutory law is similar to Iowa's, however, in granting police in most cases involving minor traffic offenses the discretion either to cite or arrest the driver.
Under California law, an officer making a routine stop for a traffic violation may arrest a motorist who fails to produce proof of identity and, within the limitations of the Fourth Amendment, may search the vehicle incident to the arrest.
