It should be noted that the Canadian Criminal Code is not a code in the civil law meaning of the term, because it does present principles in any logical way.
Other important Canadian criminal laws are the Firearms Act, the Controlled Drugs and Substances Act, the Canada Evidence Act, the Food and Drugs Act, the Youth Criminal Justice Act and the Contraventions Act.
It was based on a drafted code called "the Stephen Code", written by Sir James Stephens as part of a Royal Commission in England in 1879, and influenced by the writings of Canadian Jurist George Burbidge.

Note that justification for the use of reasonable force against a child under certain conditions is a concept specifically referred to in the actual text of section 43.
43 of the Canadian criminal code thus has to do with the criteria in the Oakes test relating to whether the means used to achieve the objective are "reasonable and justifiable in a free and democratic society".
Section 43 is, furthermore, not rationally connected to the objective of preventing the criminalization of parents for the use of trivial or non-abusive force.

The majority of the SCC in Canadian Foundation, it is held, inappropriately equates the will of the people (that is, the perceived majority view of the adult Canadian population) in regards corporal punishment of a child with what is allegedly both constitutional and in the child's best interests.
It was not until the 1953-54 re-enactment of the Criminal Code that Parliament replaced "it is lawful" with "justified".
The Court in Canadian Foundation held that parents in administering corporal punishment to the child were not acting on behalf of the State and declined to answer the question in regards to teachers administering such punishment (Canadian Foundation paragraphs 48-49).

Thus there is room for argument both at common law and under Canadian criminal law, as to which analysis of the prima facie legality or illegality of surgical interventions is more correct legally and, further, which is more desirable, taking into account the wider ramifications of each approach.
The aim of the common law of crimes and of the Criminal Code is protection of the person, and at the time these rules were developed, a person may well have been better protected by a prohibition against surgery, unless some justification were shown.
