  Supreme Court of Canada - The Canadian Judicial System
The power to appoint the judges of the superior courts in the provinces - which includes the provincial courts of appeal as well as the trial courts of general jurisdiction - is given to the federal government, as is the obligation to provide for the remuneration of those judges and the authority to remove them.
The Supreme Court of Canada sits at the apex of the structure and, consistent with its role as "a General Court of Appeal for Canada", hears appeals from both the federal court system, headed by the Federal Court of Appeal and the provincial court systems, headed in each province by that province’s Court of Appeal.
These latter courts can fairly be described as the lynchpin of the Canadian judicial system since, reflecting the role of their English counterparts, on which they were modelled, they are the only courts in the system with inherent jurisdiction in addition to jurisdiction granted by federal and provincial statutes.

Depending on the subject matter of the action, and the court in which the action is taken, the defendant in a civil matter may have a right to a trial by judge and jury.

The Court examined applicant documentation and held that it was sufficient to constitute adequate consent on the part of the agent to the compilation of the personal information but required amendment if the information was to be used in respect of a new application at a later time.
However, the Court of Appeal held the Chambers judge erred in concluding the plaintiffs had to present evidence of a prima facie case, holding they merely had to show a bona fide claim, namely a genuine intent to bring an action for copyright infringement and that the information is not sought for an improper purpose.
The Court held that in this case, because a lengthy delay between the time the request for the identities was made by the plaintiffs and the time the plaintiffs would collect their information, there is a risk that the information as to identity may be inaccurate.

On the cover, CANADA'S COURTS is described as "a social scientist's ground-breaking account of the Canadian judicial system." While I can't say that the book actually lives up to this grand billing, I can recommend the work as a solid, thorough introduction to the Canadian judicial system.
The final five chapters look at broad questions concerning judicial systems in general: judicial independence, judicial appointment processes, the use of precedent, the impact of "party capability" on success rates in the courts, the impact of judicial decisions and legal mobilization.
In "Winning and Losing in Canada's Courts," McCormick applies Galanter's (1974) and Wheeler's (1987) analyses of "party capability" to show that the success rates of different types of litigants in Canada's courts is comparable to that in their American counterparts.

In a scathing decision, a Federal Court judge ruled that Tomasz Winnicki, of London, Ont., had shown blatant disdain for the justice system in continuing his hate campaign against Jews and people of colour.
The tribunal, which ruled in April that Winnicki, 30, had in fact violated the Canadian Human Rights Act, brought the contempt motion in a case heard July 4 on the grounds that Winnicki had violated the injunction by continuing to post hate messages.
Bernie Farber, CEO of the Canadian Jewish Congress, said courts are taking hatemongering seriously and said Winnicki has no one but himself to blame for his stiff punishment because he "thumbed his nose" at the court.

WASHINGTON — Detainees at Guantanamo Bay, Cuba, are frustrated with the U.S. court system because none of them has received a court hearing, despite a Supreme Court decision a year ago that gave them the right to challenge their detention, according to detainees' attorneys.
Last June 28, the Supreme Court rejected the Bush administration's arguments that the U.S. military base at Guantanamo Bay is beyond the reach of American courts.
If the courts give detainees the right to delve into evidence gathered on the battlefield and in interrogations, "it will be rough sledding for our military commanders," says Brian Boyle, a former Justice Department lawyer involved in the detainee litigation.

Based on findings derived from five years of court transcripts and cases, Renner has pinpointed common prejudices against the victim as the major cause for light sentencing of sexual assault perpetrators in Canada.
Renner and his team are trying to change that by using their data to start a national program with the assistance of advocacy groups.

But today I had a voice mail on my cell from Crown Council stating that I would not have to appear in court because yesterday he pled guilty to the assault charge, along with other charges that he was accused of.
The thing that really retards the growth of the system, is the system itself.
Sounds more like Caveman stories, hearing this happening only in Asian and African villages….Well, here a person doing all this would definitely recieve more punishment thanks to Women’s Empowerment and all that but then again, he’ll never be caught as he’ll pay a couple of thousands the police.

The Canadian Supreme Court recently dealt a serious blow to the notion that single-payer health care is better than a competitive market system.
In a June 9th decision, the Court struck down a law banning private health insurance in Quebec province on the grounds that waiting lists had become so long that they violated patients’ “liberty, safety and security.”
The Court went on to say that “The evidence in this case shows that delays in the public health care system are widespread and that in some serious cases, patients die as a result of waiting lists for public health care.”
