Murder - Wikipedia, the free encyclopedia
In law, murder is the crime of a human being causing the death of another human being, without lawful excuse, and with intent to kill or with an intent to cause grievous bodily harm.
Depending on the state, a murder may qualify as "capital murder" if (a) the person murdered was of a special class, such as a police officer; (b) "special circumstances" occurred in the crime, such as multiple murder, the use of poison, or "lying in wait" in order to murder the victim.

Capital punishment is the lawful infliction of the death penalty, and since ancient times it has been used to punish a wide variety of offenses.
Georgia, the Supreme Court invalidated the capital punishment laws of 38 states by holding that the imposition and carrying out of the death penalty was cruel and unusual as outlined in the Eighth and Fourteenth Amendments because it was imposed in an arbitrary and capricious manner.
Although twelve of the states in which capital punishment is legal set a minimum age of 18, and another three of 17, at the age of which someone may have the death penalty imposed upon him or her, the Court ruled (5-4) this does not establish a national consensus.

John W. Lamperti | Capital Punishment
Data from 1973 to 1984 show that murder rates in the states without the death penalty were consistently lower and averaged only 63% of the corresponding rates in the states retaining it.
Another method is to follow the murder rate in a fixed state or jurisdiction and see what happened when capital punishment was abolished, and, in some cases, when it was reintroduced.
It is sometimes suggested that capital punishment provides added protection to police or to prison guards, and a number of states which have abolished capital punishment for "ordinary" murder retain it for the killing of police or prison staff.
