The Territory was formally ceded to the Government of Australia by the Government of New South Wales in 1909 and additional land at Jervis Bay was also surrendered to the Commonwealth for the establishment of a sea port for the capital.
Section 125 of the Australian Constitution specified that the capital must be north of the Murray River, placing the capital in New South Wales rather than Victoria, but at least 100 miles (160 km) from Sydney.
Tharwa is the oldest official settlement in the Australian Capital Territory, having being proclaimed in 1862.
