A while back Carmack posted as to why EAX wouldn't be in the game, and he said it was because now his method allows him to do what he wants with the sound, not just add crappy reverb effects.
Than about a year ago Carmack came out and said he would be using said technology in Doom 3, not knowing that Creative has a patent on it.
Carmack's Reverse (what the technique is commonly known as) was discussed in length on multiple high-profile sites among developers and those with a high degre of interest in development.

The technique known as 'Carmacks reverse' was in fact developed and patented before it was known as Carmacks reverse.
If your using reverse stencil shadows in anything then yes, there are legal issues you should talk to a lawyer about.
The Creative patent is to do with the idea of testing for being in shadow from "far to near" (aka ZFail rather than ZPass) which then avoids having to deal with the problem with holes when the shadow volume goes through the front clipping plane.

Frantic research on Google and intense study of Hun Yen Kwoon’s Theory of Stencil Shadow Volumes has led me to understand that this is a near plane clipping problem often solved by implementing the Z Fail algorithm (Carmack’s Reverse).
2-to use the back facing polygons as the front cap after reversing their normal.this will be a good solution if you are subtracting the diffuse lighting value for the pixels in shadow but if you are using a gray square on the screen it won't give you the right result.
Posted - 9/12/2003 6:32:37 AM There are a couple speedups that can be easily understood and REALLY help out your frame rate, as Carmack's Reverse isn't [nearly] as fast as the Z-Pass method as you have roughly triple the number of polygons in Z-Fail as Z-Pass.

After a number of weeks of trying to optimize a number of different 'routines' i came up with for creating shadow volumes of unboned meshes, i concluded that a fast way of dynamicaly drawing a satisfactory number of shadows is not really possible using b3d commands alone.
Anyway, here is the code based on Tom's code, only now Depth-Fail (Carmacks reverse) technique is used.

I received a new user sample from ViLiO concerning shadow volumes and how to use the Z-Fail technique to render correct shadows when the viewing position is inside the shadow volume.
This technique is also know as Carmacks' Reverse.
I think many of you will find it very useful since my original shadow volume sample didn't incorporate this technique.

It is a great book it explains the life of John Carmack, John Romero, and id Software.
Carmack also happend to be the same guy who said "Story in a game is just like a story in a porn film - it's there but not required." In the end, Carmack had to given into the rest of the industry and had to make a proper story-based version of his game (Doom 3).
Carmacks reverse is a clever little thing :)

no Creative apparantly had a patent on a algorithm used in the renderer, think it was even "Carmacks reverse", and they sort of flmailed id with that..
John Carmack could have rewritten it using a two pass method that would have been slower and not violated the patent as ID didn't want to have to license it from creative thus bumping up the cost of doom 3.
Instead they reluctantly worked out a deal with creative that required ID to add creative specific enhanced EAX support to doom 3 (which helps market creative cards) in exchange for allowing ID to use their shadow rendering patent without paying royalties.
