NEW CASTLE -- Ruling that a prosecutor created "a ruse designed to confuse" a key alibi witness and that a defense lawyer didn't do enough to uncover it during a 2003 trial, a Lawrence County judge yesterday vacated the armed robbery conviction of Justin Kirkwood and ordered a retrial.
The judge said Tolvanen compounded the rights violations during closing arguments when, despite knowing the telephone records contained no local calls, she told the jury that if there were any issues with them, the defense would have presented evidence about them.
Lawrence County District Attorney Matthew Mangino accepted the ruling yesterday, and pointed out that while the judge declared Tolvanen's actions "clearly improper" and "egregious," they did not rise to a level of "prosecutorial misconduct," which would have barred retrial.

Fund for a Better Waterfront - Stevens' proposals negate Hoboken's opportunity for continuous waterfront park
On the property between Sinatra Park and Castle Point Park, Stevens has proposed blocking the waterfront with a building 400 feet long -- the length of a long Hoboken city block.

Hoboken’s public park is already 70% finished, but with these few key parcels of land yet to be developed we have the unique opportunity to pull the waterfront together as a cohesive, fully accessible destination point for all of the public, for generations to come.
