The subgenre has always had two strains: the espionage novel is procedurally realistic, morally ambiguous, nicely written, has little sex and only brief violence, and is almost always produced by a Brit.

Reflecting the more serious nature of foreign government-sponsored economic espionage, an individual convicted of violating 18 U.S.C. can be imprisoned for up to 15 years and fined $500,000 or both, whereas a defendant convicted for theft of trade secrets under 18 U.S.C. can be imprisoned for up to 10 years and fined $250,000 or both.
The first provision, codified at 18 U.S.C. § 1831(a), is directed towards foreign economic espionage and requires that the theft of the trade secret be done to benefit a foreign government, instrumentality, or agent.
