CROA 2707: CHAHAL, S.   (Site not responding. Last check: 2007-11-06)
Chahal’s previous false statements to the Workers’ Compensation Board, that the Company had reasonable and probable grounds to engage in surveillance of his activities during the period of his absence from work, a period in relation to which he was then making an indemnity claim.
Chahal attempted to revise his earlier statement, recounting, during the course of his disciplinary interview, that he and his family decided that he should try doing some work to see how he would feel, and that he therefore undertook the sod laying, with the benefit of some Tylenol 3 tablets.
Chahal did, as originally suspected by Dr. Battersby, feign the injury to his back or, alternatively, the gravity of that injury, providing false information to the Company to support a claim for a compensable absence from work which was fraudulent and which, ultimately, was not allowed.

In October 1985 Mr Chahal was detained under the Prevention of Terrorism (Temporary Provisions) Act 1984 ("PTA") on suspicion of involvement in a conspiracy to assassinate the Indian Prime Minister, Mr Rajiv Gandhi, during an official visit to the United Kingdom.
Mr Chahal was arrested in connection with this incident, and was brought to court in handcuffs on the final day of his trial.
In view of the Government's proposal to return Mr Chahal to the airport of his choice in India, it is necessary for the Court to evaluate the risk of his being ill-treated with reference to conditions throughout India rather than in Punjab alone.

Mr Chahal, 57, came to Britain illegally in 1971 in search of work and was allowed to stay in 1974, after an amnesty.
Before Mr Chahal's case reached Strasbourg, the Court of Appeal had decided that the home secretary was entitled to balance the risks to Britain of allowing an individual to stay against the risks to the individual if he were expelled.
But, by a majority of 12 votes to seven, the judges in Chahal said that this did not mean that there was "any room for balancing the risk of ill-treatment against the reasons for expulsion in determining whether a state's responsibility under Article 3 is engaged".

The Court also stated that the UK was in violation of Article 5(4), which guarantees court review of the lawfulness of detention, because the advisory panel, consisting of three people appointed by the Home Secretary, was not an effective judicial control over the deprivation of liberty.
