In August 1899 the crown consented to the appointment of a new judge of the High Court in the chancery division on an address from both Houses of Parliament, pursuant to the 87th section of the Appellate Jurisdiction Act 1876.
The great difficulty in the chancery division always was to secure the continuous hearing of actions with witnesses, as nearly one-half of the judge's time was taken up with cases adjourned to him from chambers and other administrative business and non-witness actions and motions.

A chancery court, or a court having the jurisdiction of the chancery court, shall be held in each district, at a place to be fixed by law, at least twice in each year, and the chancellors may hold court for each other when they deem it necessary, and shall do so when directed by law.
Registers in chancery shall be appointed by the chancellors of the respective divisions, and shall have been at least twelve months before their appointment, and shall be at the time of their appointment and during their continuance in office, resident citizens of the district for which they are appointed.
The clerk of the supreme court and registers in chancery may be removed from office by the justices of the supreme court, and by the chancellors, respectively, for cause, to be entered at length upon the minutes of the court.
