(Chatam Sofer) theorizes that the prevalence of this practice can be traced to a sixteenth century incident which involved two publications of the Rambam's Mishneh Torah by two competing publishers.
Ironically enough, although the Chatam Sofer views Rabbi Isserles' ban as the prototype of all future rabbinical bans, he himself writes that the enactment of these bans is not out of concern for the financial loss of the first publisher (as Rabbi Isserles suggested).
Rabbi Sofer draws a rather sweeping, far reaching principle, based on the "fisherman model." It can be formulated as such: One who has expended effort in the attainment of a certain state (apart and beyond the ownership of any tangible property) is legally entitled to the ensuing profits.

In addition to his educational duties and religious functions, he devoted his life to juridical matters and was a “baal din,” a chief judge of the rabbinical court.
In 1809, when Bratislava was besieged by Napoleonic troops, the Chatam Sofer took refuge in the nearby village of Saint Jur from where he organized charitable activities to help his fellow citizens who were affected by the war.
He was a voluminous writer, composing numerous volumes of responsa, sermons, commentaries, letters, poems, and a diary - all bearing the imprint of his ferevant Orthodoxy.

This is what the universally acclaimed Sephardic Chacham, Rabbi Chaim Chizkiyahu Medini, has to say in Sedei Chemed, his encyclopedia of Jewish Law: "In every generation there must be a person, who if they are worthy, will be the Messenger in this manner they assessed in every generation who this person was."
Likewise, Rabbi Moshe Sofer, famed author of the Chatam Sofer, writes in his responsa: "From the very day that the Temple was destroyed someone is alive who in his righteousness has the potential to be the Redeemer.
When the time of Redemption arrives G-d will reveal Himself to this person and send him forth.
