The chief justice presiding over the five-judges bench, hearing petitions challenging the elevation of three judges from LHC to SC, observed that Justice Bashir Jehangiri, who recently retired as Chief Justice of Pakistan, was not a senior judge when he was elevated to supreme court.
The principle of seniority in the appointment of judges, declared constitutional convention by the apex court, was applicable to all the judges and to the chief justices alone.
Chief Justice Sheik Riaz observed that the convention of appointing senior-most judge as the chief justice was strengthened from the language of the constitution.

Pakistan emerged from an extended period of agitation by Muslims in the subcontinent to express their national identity free from British colonial domination as well as domination by what they perceived as a Hindu-controlled Indian National Congress.
Accordingly, on August 14, 1947 Pakistan, comprising West Pakistan with the provinces of Punjab, Sindh, Balochistan, and the Northwest Frontier Province (NWFP), and East Pakistan with the province of Bengal, became independent.
Each province has a high court, the justices of which are appointed by the president after conferring with the chief justice of the Supreme Court and the provincial chief justice.

The appointment of Justice Chaudhry Iftikhar Hussain as chief justice of the Lahore High Court, superseding Justice Fakhrunisa Khokhar, long serving woman judge of the LHC, negated the Supreme Court’s recent ruling on the principle of seniority, he said.
Mr Khairi, head of Al-Jihad Trust, said that the appointment of a junior judge of the LHC as chief justice, was a blatant violation of the Judges Case.
The present chief justice of Pakistan, he said, had become the chief justice only because of the Judges Case and if he continued succumbing to the desires of the executive, the applicability of the seniority principle would also be abandoned in the Supreme Court as well.

Pakistan’s military saviours, their list seemingly endless because when one departs (often unceremoniously) there is always another in the wings desperate to take his place, have never been content to do their soiled work by themselves.
But the trend under the present chief justice to take note, often suo moto, of issues affecting the public interest, issues that seldom claimed the attention of the Supreme Court before, is setting a powerful new precedent.
It goes to the credit of Chief Justice Iftikhar Mohammad Chaudry that he is doing exactly this and not hiding behind the excuse, that would have been readily available to anyone less energetic, that the Supreme Court was meant for ‘higher’ things (such as, I suppose, the doctrine of necessity).
