Nationality law is the branch of a country's legal system wherein legislation, custom and court precedent combine to define the ways in which that country's nationality and citizenship are transmitted, acquired or lost.
Nationality law is often discussed or studied along with immigration law (for those immigrant-receiving countries such as the United States, Canada, Australia and New Zealand) and with refugee or asylum law.
Nationality law in Europe tends to be based upon the Napoleonic Code which established that for purposes of nationality, that of the father was primary.

Most people who are of Chinese nationality born in China before 1949 acquired PRC nationality on 1 October 1949 if still living at that date.
Hong Kong ethnic Chinese with British National (Overseas) status, or acquired British citizenship through the British Nationality Selection Scheme before the handover of Hong Kong are not recognized by the Chinese government as they have lost their PRC Citizenship automatically.
Ethnic Chinese in Hong Kong with a foreign family name are not eligible to obtain a Home Return Permit to travel to mainland, they must obtain a visa using their foreign passport just like other foreigners.

Dan Shao explores trials in which nationality law was contested for political purposes to understand historical changes in the practice of nationality law beginning in the late Qing.
The 1929 Nationality Law remained in effect until the ROC government revised it in 1990 and 1991.
The ways in which Nationality Law was practiced in these cases reveal that the national blood lineage, though imagined, has been applied as objectively and defines Chinese identity legally with concrete consequences that still have impact on historical borderlanders in Taiwan, Hong Kong, and Macau at the turn of this century.

With the exception of the Chinese Exclusion Act of 1882, the two bodies of immigration and nationality law were not coordinated, nor did either make any reference to the other.
Case law was their only guide, for there was no central or national authority to answer judges' questions regarding the finer points of naturalization law or procedure.
The law placed the Bureau of Immigration and Naturalization in "charge of all matters concerning the naturalization of aliens," with the general purpose of promoting uniform naturalization practices nationwide.

The original U.S. naturalization law of March 26, 1790 (1 Stat 103-104) provided the first rules to be followed by all of the United States in the granting of national citizenship.
At that time and by that law naturalization was limited to aliens who were "free white persons" and thus left out indentured servants, slaves, and most women, all of whom were considered dependents and thus incapable of casting an independent vote.
While nationality law allowed some variation in naturalization requirements, by the turn of the 20th Century many Americans were concerned with variations in naturalization procedures and the increasing lack of uniformity.
