Chou also sought a declaratory judgment under 28 U.S.C. §§ 2201 and 2202 that she is the sole inventor or, in the alternative, a joint inventor on the ’688 patent and the WO ’050 application, and that she is a joint inventor on the ’713 and ’328 patents, WO ’933 application, and PCT ’292 application.

Chou was involved with his government's delicate talks with Stalin between 1949 and 1953 and the cease-fire talks in the Korean War, and he made his mark at many important international conferences during the 1950s, such as the 1954 Geneva Conference ending France's rule in Indochina and the 1955 Bandung meeting of Third World nations.
The often pragmatic and moderate Chou was attacked by radicals during China's "Cultural Revolution" after 1966, but he kept his position and influence, which was demonstrated in 1971 and 1972 when he was a central figure in the Chinese-U.S. rapprochement.
In 1972, Chou was diagnosed with cancer and died four years later in Beijing on January 8, 1976.

Enraged and betrayed, Dr. Chou sued Dr. Roizman, the University of Chicago, and the company that had licensed the technology alleging: 1) that she was the rightful inventor and should be added as an inventor to the patent and 2) state law claims of conversion, breach of fiduciary duty, breach of contract, and unjust enrichment.
According to the trial judge, because Dr. Chou's employment contract required her to assign the invention to the University, she had no ownership interest in the patent, even if she could prove that she was the rightful inventor.
While the trial court was correct in finding that Dr. Chou had no ownership interest in the patent because of her employment agreement with the University of Chicago, such an employment agreement is inapposite to a suit challenging the inventorship of the patent.
