		Ashcroft's insistence that judges should leave executive officials as the sole arbiter of an accused individual's fate ignores the very real danger of executive overreaching.
		Ashcroft's intimation that judges have no role in national security matters, and that recent judicial decisions curtailing executive actions reflect "judicial activism," is not simply wrongheaded but dangerous.
		It would be unfortunate for courts to respond to Ashcroft's attacks, which are surely only the first of an oncoming barrage, by backing away from their obligation to review constitutional claims.
