Article Citizen's Arrest, Criminal Defense Attorneys
In general, all states permit citizens arrests if a criminal felony (defined by the government as a serious crime, usually punishable by at least one year in prison) is witnessed by the citizen carrying out the arrest, or if a citizen is asked to help apprehend a suspect by the police.
In general, the arresting party must notify the suspect as to why he or she is being arrested, and may enter the building or private residence where the suspect is residing, using a reasonable amount of force to apprehend the suspect.
A citizen who violates a suspects rights, or who violates the applicable state law in detaining the suspect, (for example, arresting a suspect for a misdemeanor when the state statute requires a felony for a citizens arrest), risks being sued or even charged with a crime.

When a citizen attempts a citizen arrest, the first question in the mind of the person being arrested is "what authority do you have?" And the next question is, "do you have a gun to enforce an arrest?" Lawbreakers know citizens don't usually have permits to carry handguns.
If a citizen acting on his own initiative, without police knowledge or sanction, and unknowingly or accidentally but illegally, obtained certain evidence and later gave the evidence to the police anonymously (or under a confidential agreement when negotiating for a reward), it could be used against the lawbreaker in court.

ECS may also serve as a citizen’s check on what has been termed “capture,” the tendency for regulatory agencies over time to become familiar and then collegial with the entities that they regulate, leading to what some believe is an overly lenient approach to regulation.
