Hefflefinger, Inc. v. City of Portland
The City is obligated, pursuant to federal law, to "maintain a fee and rental structure for the facilities and services at the airport which will make the airport as self-sustaining as possible.
See 30-A M.R.S.A. The City was authorized to charge Alamo and Thrifty for their use of the airport and for the services the City provided them because the statute does not limit its application to on-airport concessions.
When the City imposed the charge, the City enumerated its legitimate government purpose to preserve "order and peace at the airport" while "providing for the public health, safety and welfare" and defraying the costs of "constructing, operating, maintaining, and improving the public airport facilities."  Summary: AT&T v. City of Portland.
Both the City and the County decided to condition their approval of the applications on ATandT's agreement to provide open access to all ISPs to its cable network in Portland and Multnomah County.
While the decisions by the City and County (and the Congress and the FCC) were based in part on policy considerations, the U.S. District Court does not have authority to judge whether mandating open access to broadband cable networks is good policy.
Portland adopted an ordinance and Multnomah County adopted a resolution, both of which mandated that ATandT provide ISPs access to its cable network.
