In the News (Thu 31 May 12)

liibulletin: Clearstream Wastewater, Inc. v. Hydro-Action, Inc.
Clearstream Wastewater Systems, Inc., ("Clearstream") is the licensee of U.S. Patent No. 5,221,470 (the '470 patent), directed to a wastewater treatment apparatus utilizing aerobic bacteria to digest solid organic particles in wastewater.
Clearstream appealed, arguing that the district court erred by limiting its construction of the means-plus-function claim language to exclude from coverage a corresponding structure that was in the prior art.
Clearstream further argued that the prosecution history supports such a claim construction as the patent application indicates that the point of novelty for the claims was the new filtering system, not the new flexible-hose aerating system.

PINR - The Political and Industrial Implications of the Clearstream Scandal
Clearstream's activities are related to electronic transitions, whereby reporting, risk margining, netting, taxation as well as failure handling are the core of its business.
The current Clearstream scandal is also known as "the second Clearstream affair," and is not to be confused with a previous one (dating back to 2001) linked to alleged money laundering and tax evasion.
A credible hypothesis is that Clearstream's electronic network had been hacked by Lahoud, who probably fell prey to a so-called "honeypot." A honeypot is a kind of anti-hacker trap, designed to deflect and counteract attempts at unauthorized use of information systems since it is designed to contain information that would be of value to pirates.

It is difficult to imagine a scandal quite like Clearstream in the US, not that we don’t have a lot of our own corruption problems involving politics and the aerospace industry.
At a time when the demand for launch services and high end communications satellites is slowly recovering and when the Ariane 5’s teething problems have been put behind it, the Clearstream scandal looks to be yet another obstacle to France’s ambitions to make the EU into a first-rate space power.
The other European states, particularly Germany and Italy, who have now subordinated most of their space ambitions to those of Paris, must now rethink to what extent they want to be tightly bound to a company or companies who are now plunged into what promises to be a drawn-out, bitter, and politically destructive struggle.
