Contractor's reliance upon the Clerk of Works
Occasionally, a Clerk of Works may be engaged directly by the architect and responsibility for the performance of his duties will carry directly through the architect's terms of engagement.
The responsibility of the Clerk of Works was examined by the Court of Appeal in the case of Scott Wilson Kirkpatrick and Partners -v- Ministry of Defence.
The Clerk of Works supervision was intended as an additional security for the benefit of the employer, the Ministry of Defence, not to provide an excuse or justification for the contractor not performing its contractual obligations.

The Clerk of the Works   (Site not responding. Last check: 2007-11-03)
Clerks usually trained as apprentices in the building trades or surveying, and then worked their way through low-level jobs under a major contractor or in the Metropolitan Board of Works.
Their duties, outlined by Bazalgette in an 1868 report, were to account for all the contract specifications, measure the contractor's work, regulate construction lines and levels, and assure the quality of materials used.
Clerks of works were usually hired on a temporary basis and shifted from site to site as senior engineers saw fit.

A Clerk of Works provides a site inspection service that will undoubtedly add quality and value for money to any project.
A Clerk of Works has become even more important due to the lack of trade training in the construction industry which has led to poor standards of workmanship which will eventually mean a lack of experienced tradesmen to progress into management, consequently affecting quality control on site by the contractor.
The Clerk of Works will liaise with the design team and the contractor and can often look at things from a 'tradesman's' point of view to show the best way to solve a problem, keep the job on programme and, most importantly, save money for the Client.

However, the increasing use of large packaged subcontracts, overseen by main contracting staff who often have relatively little practical experience of the processes which they are managing, has made this an important and valuable role where a quality finish is required.
PDM Consultants provides qualified Clerks of Works and former construction management professionals, to clients (under direction of the architects, or building surveyors), to provide thorough contract monitoring, which can be tailored to the particular requirements of the client and project.
