Codification - Wikipedia, the free encyclopedia
In law, codification is the process of collecting and restating the law of a jurisdiction in certain areas, usually by subject, forming the legal code.
The codification movement developed out of the philosophy of the Enlightenment and began in several European countries during the late 18th century (see civil code).
The official codification of Federal statutes is called the United States Code.

LINDSAY FARMER | Reconstructing the English Codification Debate: The Criminal Law Commissioners, 1833-45 | Law and ...
Advocates of codification in England bemoan the partial or incomplete modernization of the common law and the institutions of law and government, just as the conventional accounts of European codification posit an indissoluble link between the reform and codification of the penal law and the formation of the modern nation-state.
The apparent failure of the codification project in England would suggest that the English law is, in some sense, premodern and anachronistic, lacking certain ideas and institutions and possessed of a lingering and inexplicable attachment to the arcane rituals of common law adjudication.
Codification for Bentham required that the very foundations of the science of legislation be laid bare to allow the construction of a complete body of laws grounded on natural and universal principles.

In some countries such codification is done by a body constituted by the state, such as the French Academy.
Codification often happens due to new inventions, changes in values or other cultural influences.

 Codification
We note finally that the process of codification is likely to be a path dependent one and this implies that efficiency is not an intrinsic attribute of the codification of a certain type of knowledge, but is rather the result of the dynamics and emergent properties of the system under consideration.
Codification typically entails fundamental transformations in the way knowledge is organized, so the codified knowledge-base cannot exactly cover the tacit knowledge-base for which it tries to substitute.
This tripartite analysis of codification further implies that the major costs of codification are born in the process of stabilizing the knowledge environment.

A "codification" is also to be distinguished from an unofficial "compilation" that constitutes a collection of legal rules (perhaps with added commentary or structure) but that does not itself have the force of law.
The conditions of codification can be present in degrees, and the degree to which they are present bears on the character of the codification, and especially on the exclusivity and "reach" of a code.
A singular theory and program of codification would in any event have been difficult for most of the early proponents of codification to muster because of their own intellectual nature and professional bent: "Being, by and large, practical men of the common law, they were not comfortable with legal philosophy or theory.

More exactly: the apparent preceding forms of heroic codification like the trickster-, (hare- and redhorn-) cycles (in the mythologies of the northamerican indians) and the later evolving theisms were reconstuctions and reinterpretations of the development of humans as cultural beings.
They were constructed by the use of dreamlike forms, mediated by weak and often collapsing forms of codification, similar to the forms that could be found in the oral tradition of fairytales.
All those attempts negate the horizontalized, oscillating and bridging codification that emerged within the evolution of placental mammals and came to first merits within the twinlike shamanic accesses to the inner and outer worlds.

Codification will also compliment the modernisation work under the Government's Programme of Better Regulation, by addressing those pre 1922 criminal law statutes which continue on our statute book despite the difficulties in accessing these texts in our modern technological era.

Tax Analysts: Free Bulletins: Insurance: Insurance Tax Update -- Vol. 6, No. 2: NAIC Codification Delayed
When the National Association of Insurance Commissioners’ Working Group on codification of Statutory Accounting Principles (the Working Group) completed the public hearing phase of the codification project this summer, it had hoped that the project would gain final approval at the NAIC's December 1997 or March 1998 meetings, with implementation in 1999.
The NAIC’s Executive Committee was asked to approve the codification at the Seattle meeting, and NAIC by-laws preclude plenary session voting -- required for final approval of the codification -- from taking place at the same meeting as the Executive Committee's approval vote.
This issue -- which is separate from the codification itself, arose when of some commissioners challenged the AICPA's position that the codification, when adopted, should become the basis on which they will opine on statutory financial statements.

Although the failure to grant OCBOA status would preserve states' authority to adopt their own accounting practices, it would also raise the specter of a competitive disconnect to the extent that similar companies in different states may have different financial results due to divergent state accounting rules.
Although the ultimate degree of uniformity among the individual states may be something less than hoped for, the mere fact that several legislatures will be reviewing their statutory accounting rules in toto itself warrants heightened attention from insurance company tax professionals.
