  Ontario Government Settles Lawsuit over Port Colborne Nickel Pollution
Toronto, Ontario – Inco now faces a proposed $750 million class-action lawsuit alone after the Ontario Ministry of the Environment agreed to settle with the Port Colborne, Ont. resident who launched the action on behalf of thousands of families from the area.
The Plaintiff recently served notice that he is seeking leave to appeal to the Ontario Court of Appeal from lower court decisions which declined to certify the claim as a class proceeding.
The settlement with the Ontario Ministry of the Environment is subject to court approval under the Class Proceedings Act.

The city is named after Sir John Colborne, a British war hero and the Lieutenant Governor of Upper Canada at the time of the opening of the First Welland Canal.
There are two high schools in Port Colborne, the Port Colborne High School and the Lakeshore Catholic High School.

In 2001, Port Colborne resident Wilfred Pearson launched a $750 million claim against Inco, the Ontario government and others for alleged community-wide pollution caused by the nickel mining and refining company.
To date, two levels of Ontario courts have held that while individual actions can still be brought against Inco, the claims are not suitable to proceed as a class action.
Earlier this week, Ontario's Court of Appeal released its decision allowing all three to present arguments on the issue of costs.

This Cenotaph was constructed in memory of the men who gave their lives in World War I and World War II, from Port Colborne.
In 1952, a parade of Canadian Corps Unit 43 and the Canadian Legion Branch 56, preceded dedication ceremonies at the Cenotaph, where Major G. Smith Macdonald unveiled the new bronze plaque bearing the names of the fallen of both World Wars, replacing the old plaque which bore only the names from the first World War.
In 1952, a new plaque was installed on the Cenotaph in the northern section of Port Colborne to honour the names of those killed in the two World Wars, from the former Humberstone Village.
