Collecting Societies are voluntary associations of right holders (authors, interpreters, editors and others) that aim to protect their interests in their countries and also abroad.
Collecting societies also seek to sign agreements with other collecting societies established in other countries, due to the cross-border dimension of the exploitation of copyright and neighbouring rights.
Collecting societies agree that each one will collect the remuneration to pay the copyright or neighbouring rights holder resident in one of the countries and send the amount of money to the corresponding collecting society in that country of residence.

In the GEMA and GVL decisions 2, the Commission has stated that a collecting society in a dominant position is not allowed to exclude rightowners from other Member States, and that on the other hand collecting societies should not limit a member's ability to leave the society by joining the society of another Member State.
This is a problem under Article 86 since a collecting society is, for its own territory and for the category of rights it represents, normally the only possibility for rightowners to ensure the management of their rights and is therefore in a dominant position.
That society centrally collects the royalties which are subsequently passed on to the relevant societies in the different Member States whose rights have been used for the manufacture of the record.
