Similarly, in the Hot Springs decision that is the subject of this petition, the Montana court explicitly adopted by reference its reasoning in the Intertie decision (id. at 25a) and again stated that a "tax for the beneficial use of property, as distinguished from a tax on property itself, is commonplace." Id. at 27a.
Petitioner maintains that Montana's use tax is similarly discriminatory because the restriction to lines of at least 500 kilovolts results in a greater tax burden on electricity that is generated and transmitted in interstate commerce.
Evidently, the Colstrip owners are referring to 16 U.S.C. 839c(c), under which the BPA must purchase electricity generated by privately owned utility companies at the average system cost of the utility's resources, and offer, in exchange, to sell an equivalent amount of electric power to the utility for resale to residential users within the region.

When steam locomotives were in their heyday, crisscrossing Montana, hauling passengers, freight, mail and other goods, the coal to fire those locomotives came from an area in southeastern Montana that has become synonymous to coal mining.
Even the name, Colstrip, is a combination of the word "coal" and the process used to extract it from the ground "strip mining." A Montana Power subsidiary started mining the coal in the late 1960s, and at that time Colstrip consisted of about 60 houses, two churches, a school, a grain elevator.
Today, Colstrip is a thriving community in the shadow of the huge electric generation plants.

PPL Montana’s Colstrip power plant toppled a 13-year generation record by producing more than 15,737,000 megawatt-hours of electricity in 2005.
Colstrip’s outage was completed eight days ahead of schedule, which also helped the plant set the new generation records.
Colstrip’s four units have a total generating capacity of 2,094 megawatts.
