Jose Alvarez, president of the American Society of International Law and the executive director of the Columbia University Law School’s Center on Global Legal Problems, discusses the role and limitations of international law in a USINFO webchat.
International law is limited by the fact that unlike national law, it lacks a single police power to enforce it, a single body charged with making global rules for all, or a single court with automatic jurisdiction to decide disputes about the meaning of international law or apply it.
Soldiers and their commanders are under treaty law supposed to be punished for "grave breaches" of these rules and the United States is now engaged in a number of trials to criminally prosecute some of its personnel alleged to have violated the laws of war.
