Scope of Ringfence | Comalco Power (NZ) | Submissions
Parts C and G are not the only Parts of the EGRs that may conflict with the Comalco agreements, add risk and cost to the Comalco parties, or treat a Comalco party unfairly (for example by allocating it costs currently borne by another Comalco party).
It should be borne in mind that many of the obligations and restrictions in the Comalco agreements are directed to the maintenance of overall grid security whilst maintaining security of supply to the Smelter.
Comalco is also concerned with the limited scope of the ringfence from the perspective of the possibility of future change to the EGRs.

Comalco considers it important that the review of the ALA addresses the interplay between the provisions of the NTA and the ALA, particularly to ensure that there is consistency and no duplication of processes.
Comalco's preliminary view is that negotiated outcomes under the NTA (such as by ILUAs) should prevail over the requirements of the ALA in most circumstances.

Comalco is benefiting by [NZ]$1-1.5 million per week as a result of the present agreements." But the Rogernauts running Electricorp had no stomach to legislate a price increase (which would signal a return to discredited Muldoonism), and the negotiations disappeared into the realm of "commercial confidentiality," where they remain.
