On 18 October the Committee of Ministers of the Council of Europe examined the case of Paolo Dorigo v.
On 17 and 18 October, the Committee of Ministers held the fifth of the six special meetings foreseen in 2006 for the supervision of the execution of judgments of the Court (Article 46 of the ECHR).
The Committee of Ministers is the Council of Europe's decision-making body.

 About the Committee of Ministers
Article 15.a of the Statute states that the Committee of Ministers "shall consider the action required to further the aim of the Council of Europe, including the conclusion of conventions and agreements".
In 1987, at their 405th meeting, the Ministers' Deputies adopted a message to the intergovernmental committees (steering committees and committees of experts), urging them to improve their monitoring of the implementation of recommendations and resolutions.
The Committee of Ministers' essential function is to ensure that member states comply with the judgments of the European Court of Human Rights.

 Trafficking in organs in Europe
In compliance with this principle, the Committee of Ministers also considers that in the case of prisoners and other persons deprived of their liberty, any donations must be subject to guaranteed absence of pressure, to be checked by the appropriate bodies independent of the prison authorities.
In general, the Committee of Ministers considers that all transplant operations must be subject to strict supervision, enabling the public health authorities to ascertain the origin of every transplanted organ as well as the criteria for its allocation.
The Committee of Ministers agrees that the elaboration of a draft Additional Protocol on trafficking of organs and tissues of human origin is one possibility that could be considered at a later stage.

 Välisministeerium : Communiqué at 112th Session of the Committee of Ministers
Joe Borg, Minister for Foreign Affairs of Malta, the Ministers welcomed the progress made in the process of European construction since their last Session, in November 2002, and expressed their satisfaction at the accession of Serbia and Montenegro as the 45th member state of the Council of Europe.
The Ministers agreed that these issues could be further elaborated at the Third Summit of Heads of State and Government of the Council of Europe, to the holding of which they had agreed in principle at their previous Session.
The Ministers instructed their Deputies to continue their work on the agenda and the expected outcome of the Summit, taking account of the comparative advantages of the Council of Europe and its contribution to the stability and unity of the continent.

Rule 6 of the Committee of Ministers’ Rules (Rule 7 in the Draft Rules(2)) currently expressly permits the Committee of Ministers to consider communications from applicants relating to the payment of just satisfaction and the taking of individual measures.(3) It is, however, silent as to communications relating to general measures.
While the organisations are aware of the current informal practice of the Committee applying a discretion in relation to communications concerning general measures, the organisations consider that it is unsatisfactory for this position to remain subject merely to an unwritten, informal practice.
The organisations therefore recommend that the Committee of Ministers should expressly be given the discretion to consider submissions from interested bodies such as NGOs and National Human Rights Institutions in relation to the implementation of Court judgments, and in relation to referrals for interpretation of a judgment or infringement proceedings.

The Committee of Ministers’ responsibilities with regard to the European Convention on Human Rights reflect the importance of this convention, which is the cornerstone of the system of human rights protection in Europe.

There are members of our Conference who are strong in their conviction that any minister who is divorced for whatever reason is thereby disqualified to serve in the ministry and should not have standing as a minister of the Conference nor be pastor of a church.
The minister, the congregation and the Credentials Committee will do well to consider that while, in the view of many members of our Conference, it may be lawful for a divorced minister to continue to serve in the ministry, it might not be expedient.
Other ministers shall have their credentialed status suspended for a perid of review, the length of which is determined by the Credentials Committee.

 Statute of Council of Europe
The Committee of Ministers shall, subject to the provisions of Articles 24, 28, 30, 32, 33 and 35, relating to the powers of the Consultative Assembly, decide with binding effect all matters relating to the internal organisation and arrangements of the Council of Europe.
Debates on proposals to be made to the Committee of Ministers that a matter should be placed on the agenda of the Consultative Assembly shall be confined to an indication of the proposed subject-matter and the reasons for and against its inclusion in the agenda.
For this purpose the Committee of Ministers shall recommend to the governments of members the acceptance of an agreement defining the privileges and immunities to be granted in the territories of all members.

On 23 April 2001, the Committee of Ministers adopted a reply [Rec 1497(2001)] to the Assembly's recommendation 1497 (see above), on freedom of expression and the functioning of parliamentary democracy in Ukraine.
The Committee recalled that, within the framework of its own monitoring procedure, a stock-taking on the theme "freedom of expression and information" was currently under preparation on the basis of contacts made and information collected by the Secretary General.
The Committee noted that a request had been received from the speaker of the Ukrainian Parliament for assistance by the Council of Europe with a view to arranging for independent examinations in the context of measures to speed up the investigation into Mr Gongadze's disappearance.

Following an examination of the progress of the projects approved in previous meetings, the Committee approved the major strategic initiatives for the country, notably in the sectors of healthcare, tourism, culture, public administration and enterprise, as well as sectoral projects submitted by various government entities.
The Committee has approved several projects for the technological and digital modernisation of the country, and allocated a total of €125 million in funding.
At the end of August, the Committee had drawn up 55 project summaries, which were included in a strategy paper that was discussed by the Committee of Ministers at a meeting on 12 September.

In the context of freedom of the media, the Committee noted that a seminar on broadcasting regulation and a study visit for a representative of the Slovak radio and television industry were foreseen within the ADACS budget programme for the year 2000.
With respect specifically to the Roma minority, the Committee noted that this subject was the main focus of activities within the framework of confidence-building measures in Slovakia, and referred to the so-called SPOLU project.

On 9th June 1999, the Committee of Ministers of the Council of Europe adopted an interim resolution condemning human rights abuses committed by the Turkish security forces in the Kurdish regions of Turkey.
The two primary bodies of the Council of Europe are the Committee of Ministers, consisting of the Ministers of Foreign Affairs from each of the member states, and a Parliamentary Assembly, comprising delegations of parliamentarians appointed by each national parliament.
If the case was not referred to the Court, the Committee of Ministers assumed a judicial role, under former Article 32, with the right to decide whether there had been a violation of the Convention.

On 17 September 1997 the Committee of Ministers adopted Resolution 97(10) that provides further guidance on the composition, election and appointment of the Advisory Committee and the procedures to be followed in performing the monitoring functions.
The fact that the Committee of Ministers is in charge of monitoring of the Convention and not an independent body, such as is the case for the European Convention on Human Rights, has already been charged to be a serious weakness of the Convention.
It is important that the Committee of Ministers is not afraid to adopt recommendations which are critical of Parties in case of an obvious lack of compliance.
