Common Development and Distribution License (CDDL) is an open source and Free software license, produced by Sun Microsystems, based on the Mozilla Public License (MPL), version 1.1.
The CDDL was submitted for approval to the Open Source Initiative on December 1, 2004 and approved as an open source license in mid January 2005.
As the CDDL is derived from the MPL, some people claim that the license is not compatible with the GNU General Public License (GPL).

Version 1.0 was developed by Mitchell Baker when she worked as a lawyer at Netscape Communications Corporation and version 1.1 at the Mozilla Foundation.
The MPL has been adapted by others as a license for their software, most notably Sun Microsystems, as the Common Development and Distribution License for OpenSolaris (the open source version of Solaris 10).
The license is regarded as a weak copyleft.

 Carla Mott's Blog: GlassFish distribution license - clarified
The majority of the GlassFish code is available under the Common Development and Distribution License (CDDL) v1.0 and that applies to source code as well as the binary format.
As far as I understand some components like JavaMail and Activation are released under CDDL for the sources and Sun binary License for the binaries, which means I can't redistribute the jar provided by Sun while I can redistribute the sources, and build a jar myself and redistribute it.

Common rumor is that only the build system is CDDL licensed.
The software in this directory tree is free software and uses licenses that are aproved be the OpenSource Initative http://www.opensource.org/ Not all sub-projects use the same license.
Seems like this is mixed GPL and CDDL code, which is IMHO not allowed by ยง2 of the GPL.

The CDDL is a variant of the Mozilla Public License (MPL) and is compliant with the Open Source Definition.

This license, derived from the Mozilla Public License, may (or may not) be what Sun chooses to use for its possible open-source Solaris release, so it is worth a look.
The license says nothing about how the source must be made available; in theory, one could satisfy the license by requiring people to pick up the source in person at one's Mongolian software distribution center.
Interestingly, the license allows the binaries themselves to be distributed under any license, so long as (1) the source is available under the CDDL, and (2) the person distributing binaries under a different license indemnifies the copyright holders for any liabilities.

The unmodifiable part of the GPL is the preamble, which is not technically a term of the license; one can make a license equivalent to the GPL in its terms (and so compatible with the GPL), but use only free license text.
Sun's license allows modifications only if the modified license has a new name and no references to Sun (other than a notice that the new licence differs from the CDDL).
The GPL text itself can't be changed, but a derived license can be created by including the GPL file in a distribution, and then saying that the license that applies to the work is the GPL together with a set of modifications.

In today's article, entitled, "Sun thumbs nose at the GPL," Vaughan-Nichols explains why, as a derivative of the Mozilla Public License, the CDDL is not compatible with the GPL, and why incompatibility with the GPL would limit the popularity of Open Solaris.
Vaughan-Nichols quotes Linus Torvalds likening the license to "a moat against the barbarians at the gate," and quotes an executive at competitor HP comparing Sun's move to a woman announcing she's half-pregnant.
Then, in December, the company submitted the CDDL to the OSI for consideration, saying that none of the 50 existing open source licenses suited its purposes.
